A Data Protection Officer is required for public bodies, large-scale systematic monitoring, or large-scale processing of special-category data. Non-EU companies subject to GDPR usually must also appoint an EU representative (Article 27), with limited exceptions.
Both are consent-centred with breach-notification duties. DPDP has fewer lawful bases, a different penalty structure and applies to digital personal data in India. If you handle both EU and Indian data, one privacy programme can satisfy both. Read our [DPDP Act roadmap](/blog/dpdp-act-compliance-guide).
