Yes. Indian companies acting as Business Associates of US Covered Entities (hospitals, insurers, healthcare providers) are contractually required to comply with HIPAA and typically sign Business Associate Agreements (BAAs).
What is a Business Associate Agreement (BAA) under HIPAA?
A BAA is a contract between a Covered Entity and a Business Associate that sets out the permitted uses of PHI and the safeguards the Business Associate must maintain. Indian IT and BPO companies must sign BAAs with US healthcare clients before handling PHI.
Can ISO 27001 certification help with HIPAA compliance?
